I had posted a few months back; my DH has a brother and his wife that cannot manage their money (R&R) and they got a 33K 2020 Ford Escape from UB.... And that amount was to be taken off their portion of their inheritance per UB (Unknown to R&R) see previous post about vultures from a few months ago

Last week, R texted DH while he was a work and DH couldn't get back to him immediately. So, R& R when to UB and asked for a " loan" for 15K
AND wants to use *MY* Kabota with the brush hog and the flatbed trailer to haul it to their place to mow their field

sorry to bitch... But FB will not do for this type of venting

The 15K has already happened because my DH was at work The Kabota is a no-go. DH just talked to UB this morning and also found out that at the same time of the 15K loan. R&R's son also asked for and got a 5K "loan" for his upcoming wedding. These will also be deducted from their inheritance

Wow those people are very entitled. They will have the inheritance spent before the person dies.

I hope all of these inheritance deductions are being written down and made official in the will.

Yes they are, the 33K car was written is as a deduction. now the 15K and 5K will be written in too.

If UB is still living, then can't UB give the money away if he or she chooses? Where is this bookkeeping taking place? I'm not sure if it would hold up in court, unless the will gets changed as these monies are paid out?

There is no chance UB is going to need this money for assisted living or nursing home care, is there? Mom pays 6000 a month for memory care, and skilled nursing goes up to 20,000 a month.

UB pays 5K from the lowest care that they offer. This is a place that UB is very happy with. Other than an occasional lapse in memory, he is in fairly good shape. My guess is that he will eventually need more care as he ages (He just turned 89 in June)

DH is going to make an appointment with UB and his financial adviser as soon as he gets a day off

that's a good idea. I was thinking about the five year lookback period, if he is giving money away.

The last thread which said to be continued, they were trying to get his 2019.
Also, as this is a "loan", and your husband has POA, I would contact an attorney and tell them they need to come back in and sign x (repayment plan with statement saying this will be deducted from any estate money left to them, otherwise).

I meant 2019... They ended up the getting car. It only had 5K miles on it as it was only used to take him to town and appointments UB decided to let them have it and he wanted to buy himself a 2022 Ford Bronco. That's what he has now .

So does UB have enough money to pay for years and years of care for himself, so that the giving away of money will not become an issue with the five year Medicare Look Back period?

Yes, this is the problem with the idea of “please give me my inheritance early, before you die. I need it now. “

this assumption that the person who has the money will not need it in later years is naive.

Tybee, you mentioned on another thread that your mom is paying, around $6000 a month for memory care? If I remember that right that’s a hell of a deal!

My mother pays 10600 a month for memory care. The 6000 a month, not per year, represents what her income does not cover, so comes out of her savings. She still has income.

Oh duh, I meant to say my memory was your mother was paying 6000 a month which is the hell of a deal. But yeah that 10,600 a month is more like it, pretty typical.
