The courts will decide this legal issue, free-speech versus speech that incites a riot
For me, I am less interested in the legal determination than I am in Trump involving himself to the extent that he did, obviously wrong and dangerous.
From what I just heard.. everything is written up so first amendment cannot be used to get trump off. We can only hope!

Heard a legal expert on the radio this morning. Trump’s Jan 6th speech is part of the timeline/facts of the case, but he isn’t actually charged with incitement. Legal expert said that was a wise move as incitement is difficult to prove.
I likely won’t be voting for anyone for prez next year.
I hope it sticks and he ceases to be a factor. No one will miss him except the rabid MAGA types and the rabid anti-MAGA types.
What a shame that we elected these morons and that some continue to adore him.
Judging from the responses to the most recent indictments from these folks one is running for president and the other are running for vice president. Of course the one running for president has about as much chance of winning as Liz Cheney because the MAGA base isn't going to tolerate anyone disloyal to trump. Maybe a fourth failed election will convince the republican politican class that standing quietly by and letting trump run the party is a failing strategy? In the meantime an entire generation of young voters are incredibly turned off by the republican platform of hate the non-white, non-straight folks and try to throw our democracy in the trash. How the republicans will recover from this period in their history will be interesting to watch.
Pence: “As Americans, his candidacy means less attention paid to Joe Biden’s disastrous economic policies afflicting millions across the United States and to the pattern of corruption with Hunter.”
DeSantis: “As President, I will end the weaponization of government, replace the FBI Director, and ensure a single standard of justice for all Americans,” “While I’ve seen reports, I have not read the indictment. I do, though, believe we need to enact reforms so that Americans have the right to remove cases from Washington, DC to their home districts.”
Tim Scott: “I remain concerned about the weaponization of Biden’s DOJ and its immense power used against political opponents,” “What we see today are two different tracks of justice. One for political opponents and another for the son of the current president.”
Ramaswamy “Further, it's more than a stretch to call something criminal if someone is seeking legal counsel from their own lawyers. Jack Smith has created a dangerous precedent by criminalizing the behavior of Trump's lawyers who offered him legal advice, labeling them co-conspirators instead.”
Christie: “The events around the White House from election night forward are a stain on our country’s history & a disgrace to the people who participated. This disgrace falls the most on Donald Trump. He swore an oath to the Constitution, violated his oath & brought shame to his presidency.”
What a shame that we elected these morons and that some continue to adore him.

If you read the events in the timeline in the indictment itself, it looks like it was a near thing.

I remember Jan 6 so clearly. Watching it unfold in real time was horrifying. Reading the indictment it was more so. At this point, I don't know how he can get lawyers to represent him. I don't know how he can get people to keep sending him money so he can spend it on lawyers.
Remember how many years we heard about crooked Hillary and Benghazi? Nothing ever came of it. Now its all Hunter and the Biden crime family. If there is proof, bring it on.
Apparently ~70% of Republicans believe at this point that Joe Biden was not legitimately elected in 2020.

As an insurance guy who used to be a broker with a couple hundred law firms as my clients the lawyer part is fascinating to me. One of the key things that lawyers professional liability underwriters look at is how the firm handles potential conflicts of interest. So many of the coup participants are all using the same small group of lawyers, who are often being paid by trump or trump supporting entities/individuals. And the legal advice that they are getting is often not in their best interest but in the best interest of trump. (Cassidy Hutchinson is a prime example of this. Once she ditched the trump paid for lawyer her story changed markedly, to her benefit.) Once all of this has played out and lots of people are in prison a few years from now I expect the legal malpractice lawsuits against these lawyers will be fascinating to watch. (at least for an insurance nerd like myself.) Especially since most of these lawyers probably don't have professional liability insurance since no insurance company in their right mind would want to have anything to do with any of them. If any of them do have insurance it's with some small insurance company that is collecting a lot of premium now but plans to non-renew them in a year or two before the inevitable lawsuits come in.

I would think legal malpractice is very hard to prove if you’re talking about strategies.
Strategies yes. Conflicts of interest? No. The advice Cassidy Hutchinson was getting was bad. A decent lawyer will be able to prove that.
The other problem for these lawyers is that most of them don’t have experience defending the types of cases they are working. When they fail their shortfalls in knowledge of this area of law, and the resulting poor advice they gave their clients, will be easy to prove.

To expand on this thought. The attorney client privilege that prevents discovery of lawyerly communications does not extend to attorney/payor of the bills. Anyone that thinks their lawyer gave them bad advice because the person paying for the lawyer directed/asked them to will be able to get the communication records that would be able to confirm that that happened during the discovery process when they are suing their lawyer.

Today outside the arraignment someone had a big sign that said
"TRUMP 20-24 years. "
I was surprised by the lack of protesters.
