Well, we got a realtor, got the place cleaned up etc and listed. Right away we got offers (sub-asking but not too far down). Seemed to be going well until we found out the air conditioner was stripped. Now nobody who has a federally-backed loan will be able to offer until/unless we replace it. We have a cash offer but it's below what we want due to the missing a/c. BTW, this is considered a required appliance in Phx, like a furnace in colder climates. Anyway, I guess I talk to the realtor tomorrow about the whole deal.

Additionally, I want to dispute some of the charges the property management says we owe, since they did a crappy job cleaning and we had all the cleaning redone prior to listing. Can I just refuse those charges? What happens if it's a he said/she said situation? I would like them to provide photo evidence but not sure they have it.

The saga continues, sigh.>:(

This is not a legal forum, we are not lawyers in your state. You need to consult them for legal advice about what you can and can't do. Do you have pictures before and after the clean up? (your asking about them, shouldn't both sides have evidence of their claim?)
You will need to know what the contracted definition of clean is. It may be just removing any physical property left behind (and possibly storing it depending on the law), and running a vacuum, or it could be closer to what your expecting.

Thanks. It's probably not worth getting a lawyer involved esp since it would be remote and probably will exceed the amt of money involved. I will just ask and see if they have photo evidence and see if they discount anything. Mostly I'm just frustrated and tired of dealing with this. 5 years of disappointment.

One other thought comes to mind. A friend put her house on the market, with the price and the bottom dollar she would accept, Her Realtor kept trying to get her to drop the price more, based on offers that were below her bottom dollar. She was worried about just walking away free from the mortgage, and the Realtor was only worried about a quick commission.
